Clairy Chin Yean Yean is a dual-qualified Advocate and Solicitor of the High Court of Malaya and the High Court of Sabah & Sarawak. She read law and obtained her LL.B (Hons) from the University of Leeds and subsequently completed her Certificate in Legal Practice (CLP).

Clairy began her legal career at one of the largest law firms in Selangor, where she gained early exposure in civil and commercial disputes, ranging from contractual and shareholders' disputes to tenancy and contentious probate matters. She later joined Messrs RYCO Law Firm, where she advised and represented clients across a broad spectrum of industries, from SMEs to multinational corporations and foreign investors, in dispute resolution, corporate advisory, and cross-border commercial matters.

Commercial
Over the years, Clairy has developed a strong practice in dispute resolution and corporate matters, including debt recovery, execution proceedings, contractual disputes, injunctive measures, probate disputes, shareholders’ disputes, post-winding up litigation, and judicial review. Her experience spans representation before the High Court, Court of Appeal, and Industrial Court. She is recognised for her strategic thinking, meticulous attention to detail, and ability to communicate clearly and persuasively. Clairy is also known for her compassionate approach in understanding client needs and her focus on achieving commercially practical, win-win solutions through negotiation and mediation.

Family
Clairy has also been involved in advising and assisting clients across a broad spectrum of family law matters. Her work includes handling divorce and separation issues, custody and guardianship applications, wills, and the administration of estates.

Corporate & Commercial

  • Represented property developer in an application for judicial management in the High Court in Sabah and Sarawak and successfully obtained the same in order to revive one of the largest integrated development in Kota Kinabalu involving around RM1billion gross development value.

  • Involved and assisted in a high-stakes fraudulent trading case involving RM179million claim.

  • Acted as co-counsel in a contractual dispute claim involving allegations of undue influence against foreign investors, with a claim value of approximately RM160 million.

  • Represented an international corporation on a cross-border supply dispute and successfully obtained a judgment against the defendants involving around RM1million.

  • Successfully assisted a multinational company in recovering debts amounting to approximately RM500,000.

  • Co-counsel for a successful appeal in the Court of Appeal against a High Court decision for granting an injunction application affecting the progress of a high-stakes property development in the CBD area of Kota Kinabalu.

  • Co-counsel for a successful leave application for judicial review for an order of Certiorari to quash the decision of the Board of Architects Malaysia, involving a high-stakes property development.

  • Successfully obtained leave to appeal to the Court of Appeal involving multiple cases being tried and heard together with claims of more than RM1million.

  • Advised and represented foreign investors in corporate and commercial matters in Sabah.

  • Successfully defended liquidators in post winding up disputes including but not limited to defending against the creditors’ appeals against the rejection of proof of debt, defending against application for examination of liquidators, application to compromise debtor’s liability.

  • Assisted in resisting judicial review applications for an order of Certiorari to quash the decision of the Minister of Human Resources Malaysia for referring representations pertaining to the dismissal of employees to the Industrial Court for an award.

  • Represented an individual client in a defamation claim.

Family Law

  • Assisted senior counsels in a high-profile contentious probate dispute involving family tussle at the Federal Court level.

Land Law

  • Represented clients for land dispute matters involving removal of caveats, defending against an application for right of way.

  • Assisted in the en-bloc sale and transaction of plantation lands in Sabah valued at RM56million.
